Student Code of Conduct

Every Student Shall:

  • Obey the laws of his/her country and the country where he/she is studying.
  • Obey the rules and regulations of IBAS, MGWA center and its satellite centers.
  • Co-operate with the school authorities in all school matters, whether personal or on behalf of others, including providing information and evidence.
  • IBAS always requires all students to carry their student card. Students must show their student card when dealing with the administration and they must show the card when asked by person or persons authorised to do so by IBAS.
  • Attend learning sessions, except with the prior permission from the subject teacher
  • Sit for examinations, unless barred from doing so.
  • Be responsible for safeguarding and ensuring the safety of the property of IBAS used by him/her.

Every Student Shall NOT:

  • No student is permitted to be involved in any activity or activities or conduct which may damage or harm the interests, harmony, or good name of IBAS or its students, staff, officers or employees.
  • No student is permitted to use any lecture, tutorial or teaching materials which are provided to him/her by IBAS for the purpose of publication, distribution or dissemination, whether for payment or otherwise.
  • No student may plagiarise the intellectual property of others, including data, ideas, publications and inventions.
  • No student may, cheat or attempt to cheat or act in a manner that can be interpreted as cheating or attempting to cheat in an examination.
  • No student or group of students may organize, conduct or participate in any activity in the name of IBAS without permission or written instructions to do so from the center.
  • No student or group of students may promote, manage, or assist in the collection of money or contributions in the name of IBAS without permission or written instruction to do so from IBAS.
  • No student or group of students may make any statement to the Press in the name of IBAS without the written permission of IBAS

Breach of Code

A student who violates any part of the Code is said to have committed a breach of conduct.

Procedure

A student who has been accused of committing a breach of the Conduct Code under any of the rules of IBAS and is found guilty can be subjected to the imposition of any one or a combination of two or more of the following penalties:

  1. warning
  2. fine
  3. exclusion from any specified part or parts of the institution
  4. suspension from membership of the institution for a fixed period
  5. payment of compensation or damages for any damage to property and institution facilities or any third-party claimant
  6. nullification of examination results or any part of the examination results
  7. expulsion from the institution

Investigation of Misconduct

Every report of wrongdoing shall be investigated by the Investigation Committee and the Investigation Committee shall decide whether the alleged offense is serious, minor or there is no case to answer.

Serious offenses include academic dishonesty, fraud, plagiarism, any activity that adversely affects the good name of IBAS and involvement in criminal activities.

If the Investigation Committee finds that a student has committed an offense, it shall inform the offense of the offense of which he/she is accused and require the student to provide a written explanation within a reasonable period of time.

If the student pleads not guilty and his/her explanation is accepted, or the student admits his/her guilt, the Investigation Committee shall then take the appropriate action.

If the student pleads not guilty and his/her explanation is not being accepted by the Investigation Committee, the student shall be informed of his/her offense and required to appear before the Disciplinary Committee within a period not less than 14 days from the date of notification.

A student who does not make the explanation statement or does not pay the fine imposed or fails to appear before the Disciplinary Committee shall be suspended until he/she provides an explanation or pays the fine imposed or agrees to appear before the Disciplinary Committee.

Disciplinary Proceeding

  1. If the student pleads not guilty and the Disciplinary Committee finds that there is a case to answer, the student shall be asked to provide evidence, the student may call witnesses or present document(s) or other materials in his/her defense. The Disciplinary Committee can question the student or any of the witnesses and examine any document(s) or materials and the student may cross-examine any of the witnesses.
  2. If the student pleads guilty, the Disciplinary Committee shall explain the facts of the case to him/her.

On completion of the proceedings and, if the Disciplinary Committee finds the student guilty, before imposing sentence, the Disciplinary Committee shall ask the student to make a mitigation plea.

If the Disciplinary Committee also imposes the punishment of payment of compensation or damages to the Institution or a third party, the amount of compensation determined by the Disciplinary Committee shall be an amount that is fair and reasonable taking into account all matters related to the case and the persons involved in it.

A student who is not satisfied with the decision of the Disciplinary Committee can submit a written appeal providing the grounds of appeal to the President for consideration by the Institution Board, on condition that such an appeal is submitted within 14 days from the date of sentencing. The decision of the Board of Directors shall be final.

The Disciplinary Committee, with the consent of the President may delegate its authority to any officer or member of staff of the Institution to deal with any disciplinary offense.

If a student makes an appeal, this does not constitute grounds for the suspension of the   implementation of any penalty imposed or the suspension of payment of any fine or compensation ordered to be paid.

Fines shall be paid to the Financial Controller who shall then make payment to the third party, if necessary.

Any document(s) or other materials submitted before the Disciplinary Committee in the course of disciplinary proceedings shall be kept in the care of the Institution until such proceedings are completed or until the deadline for appeal has passed.

The Disciplinary Committee shall make written notes of all disciplinary proceedings before it. However, for the purposes of record keeping these notes do not need to be verbatim.

Plagiarism Policy

Plagiarism is “thoughts theft” or the wrongful acquisition of another author’s ideas, thoughts, language or expressions and presenting them as one’s own ideas without giving credit to the original author.

  •  Wording, sentences, phrases or long extract from published or unpublished paper, articles, or Internet sources without citing the source.
  • Another person’s work without citation of the sources.

MGW / IBAS instructors are responsible for checking all students’ submitted work for plagiarism by whatever means they deem appropriate. Instructors should always provide students with clear instructions and guidance about how to write their papers in their own words and how to avoid plagiarism.

Instructors will act according:

  • Level 1 Infraction: If the student commits plagiarism for the first time and the plagiarized work does not exceed 50% of the paper, instructor will send informal warning to student and require the student to resubmit the work for assessment and submit an incident report form to the Dean.
  • Level 2 Infraction: If the student repeats the plagiarism and the plagiarized work exceeds 50% of the paper, the instructor will consider applying a failing grade for the work and will submit a plagiarism report to the Dean.
  • Level 3 Infraction: If the student repeats the plagiarism and the plagiarized work exceeds 50% of the paper, the instructor will apply a failing grade for the course and receive a formal warning letter.

Minor Plagiarism

A minor plagiarism will be handled by instructions and the Registrar. There are 2 levels of minor plagiarism:

Level 1

May occur when student lacks the knowledge or awareness about plagiarism. In this case, instructor will directly ask student to read Plagiarism chapter of “Student Handbook” and request student to makeup the assignment.

Level 2

Plagiarism are breaches of academic integrity that are more serious than level one, such as:

  • submitting the same academic work or exceeds 50% content of previous academic work to more than one course without permission of instructors
  • quoting or paraphrasing the content without citing the source
  • using data or work from a report without acknowledging the sources
  • asking for help or assistance from others without acknowledgement in the final project

Sanctions for Level 2 plagiarism including:

  • informal warning from instructors
  • make-up the plagiarised work
  • reduce by one grading scale on the work

Major Plagiarism

Level 3

Plagiarism are breaches more serious than Level 2 plagiarism. Level 3 behaviors include:

  • repeat of Level 2 plagiarism
  • the plagiarised work exceeds 50% of the paper
  • submit work of other people
  • use data or content from unauthorized sources

Sanctions for Level 3 plagiarism including:

  • receive a failing grading in the subject
  • receive a formal warning letter
  • re-take the course as well as all related exams, exercises, assignment and final project
